Para tanto, sugeriu-se aos alunos da disciplina “Limitações constitucionais às escolhas públicas”, por mim ministrada no ano de 2017, 2018 e 2019, no Mestrado Acadêmico do Programa de Pós-Graduação em Direito Constitucional (PPGDC) e na disciplina “Judiciário, justiça e jurisdição administrativa I” no Doutorado Acadêmico do Programa de Pós-Graduação em Direitos, Instituições e Negócios (PPGDIN), ambos da Universidade Federal Fluminense (UFF), que desenvolvessem artigos científicos, como requisito para aprovação na disciplina, para compor esta obra coletiva. Na disciplina, cada mestrando/doutorando foi instado a escolher e explorar um tema que abordasse a “discricionariedade médica”, devendo necessariamente discutir as subjetividades ou autonomias presentes nas escolhas a serem feitas por parte dos agentes públicos profissionais da área da saúde, com foco no médico. Neste sentido, os artigos consolidados nessa obra focam o médico, agente público, apesar de alguns artigos abordarem a liberdade de decisão de outros profissionais da área da saúde. Ressalta-se que a atuação de tais profissionais, quando em atuação como particulares, não foi objeto dos artigos inseridos nessa obra. Toda situação apresentada diz respeito ao agente público, pois do contrário não há como se falar em subjetividade ou autonomia administrativa. Os profissionais particulares possuem uma imensa liberdade de atuação cujos limites são dados pela ética profissional, e cuja análise escapa ao objetivo inicialmente proposto, mas isto não significa que não se tenha analisado o aspecto ético das decisões dos médicos públicos neste trabalho. |

In the search for the roots of this understanding of welfare we shall survey, fitst, the historical background to these tensions in some early British political philosophers, starting with Hobbes and ending with Mill. We then consider the philosophical and social influences on the Beveridge Report itself, and we will trace the emergence of the philosophy of the welfare state in the era following the Second World War. Finally we consider the contemporary debate, as it relates to the 'Third Way' thinking of New Labour. 2. A mSTORICAL SKETCH In the previous section we observed that the philosophy underlying the Beveridge Report could be described as 'liberal collectivism'. What are the historical antecedents of this strange amalgam of individualism and collectivism? Within the short scope of this chapter, any account of the philosophical history must be little more than a sketch, but we can perhaps understand most debates in British socio-political thought as a continuing dialogue with the well known claim of Thomas Hobbes in Leviathan that all political institutions are founded on egoistic motives. |
