As a result, moral theory tends to focus only on humans where human autonomy is foundational or only on God where divine commands capriciously rule. However, the moral theology of Thomas Aquinas overcomes this dichotomy. For Thomas, humans reach their perfection by participating in God's wisdom and love. Perfecting Human Actions explores the ways humans participate in eternal law--God's wisdom that guides and moves all things to their proper action. The book begins with a thoughtful examination of the philosophic recovery of the notion of participation in Thomistic metaphysics. It then explains Thomas's theological understanding of the notion of participation to show how humans are related to God. It is discovered that when performing human actions, humans participate in the eternal law in two ways: as moved and governed by it, and cognitively. In reference to participation as moved and governed, humans are directed by God to their proper end of eternal happiness. This mode of participation can be increased by perfecting the natural inclinations through virtue, grace, and the gifts of the Holy Spirit. In reference to cognitive participation, humans as rational creatures can know their proper end and how to attain it. Through this knowledge of moral truths, the intellect participates in the eternal law. Cognitive participation is perfected by the intellectual virtues (especially faith) and the gifts of the Holy Spirit (especially wisdom). The book concludes by showing how the notion of human participation in the eternal law is a much better foundation for moral theory than the contemporary notion of autonomy. His metaphysical jurisprudence remodels ethics upon this, rather than on a moral precept. “Eternal law” governing the world determines “natural law”, reflected in human legislation (a variety of the “anthropic principle”). Finally, law, unwritten, is infused spirit as self-consciousness, “universal of universals”. Acquired virtues elicit this, become effusion, represented in religion as gifts or graces. But mind’s or spirit’s omnipresence, necessarily “closer to me than I am to myself”, supersedes the abstractions of heteronomy versus autonomy. The habitual well-being brought by prudence, justice, courage and temperance prompts this picture of gifts and graces. The “theological virtues”, faith (explicit or implicit) and hope fulfilled in love, “crown” our natural rationality, set toward as being the universal. “Become what you are”. Heteronomous law is thus “defused” at root by grounding it entirely upon immovable spiritual (mental) inclination towards universal fulfilment as naturally desired, reflection shows. Virtue, finally, is best assessed as a capacity for the individually beautiful yet habit-based action, Aristotle’s to kalon. Aquinas puts this picture as summed up in the beatitudes of the “Sermon on the Mount”. |

This tradition holds that the world is ordered, intelligible and good, that there are objective moral truths which we can know and that human beings can achieve true happiness only by following our inborn nature, which draws us toward our own perfection. Most accounts of the natural law are based on a God-centered understanding of the world. After the Natural Law traces this tradition from Plato and Aristotle to Thomas Aquinas and then describes how and why modern philosophers such as Descartes, Locke and Hobbes began to chip away at this foundation. The book argues that natural law is a necessary foundation for our most important moral and political values – freedom, human rights, equality, responsibility and human dignity, among others. Without a theory of natural law, these values lose their coherence: we literally cannot make sense of them given the assumptions of modern philosophy. Part I of the book traces the development of natural law theory from Plato and Aristotle through the crowning achievement of Thomas Aquinas. Part II explores how modern philosophers have systematically chipped away at the only coherent foundation for these values. As a result, our most important moral and political ideals today are incoherent. It does so by analyzing the conditions for the existence of a juridical domain of natural law from the perspective of the tradition of Thomistic juridical realism. In order to highlight the need to reconnect with this tradition in the context of contemporary legal philosophy, the book presents various other recent jurisprudential positions regarding the overlap between law and morality. While most authors either exclude a conceptual necessity for the inclusion of moral principles in the nature of law or refer to the purely moral status of natural law at the foundations of the legal phenomenon, the book seeks to elucidate the essential properties of the juridical status of natural law. In order to establish the juridicity of natural law, the book explores the relevant arguments of Thomas Aquinas and some of his main commentators on this issue, above all Michel Villey and Javier Hervada. It establishes that Thomistic juridical realism observes the juridical phenomenon not only from the perspective of legal norms or subjective individual rights, but also from the perspective of the primary meaning of the concept of right (ius), namely, the just thing itself as the object of justice. In this perspective, natural rights already possess a fully juridical status and can be described as natural juridical goods. In addition, from the viewpoint of Thomistic juridical realism, we can identify certain natural norms or principles of justice as the juridical title of these rights or goods.
