ricci rivero age: Ramazan Çağlayan'ın İdari Yargılama Hukuku İsimli Kitabı Hakkında Eleştiriler Kemal Gözler, 2013-05-15 Elinizde tuttuğunuz bu kitap, Kırıkkale Üniversitesi Hukuk Fakültesi öğretim üyesi Prof. Dr. Ramazan Çağlayan’ın İdarî Yargılama Hukuku (Ankara, Seçkin, 2011, 696 s.) isimli kitabında, benim İdare Hukuku (Bursa, Ekin, 2003, 2 Cilt, 2800 s.) isimli kitabımdan yapılmış usûlsüz alıntılar bulunduğu göstermek amacıyla yazılmış bir eleştiri kitabıdır. Ramazan Çağlayan, burada eleştirdiğim İdarî Yargılama Hukuku isimli kitabının Şubat 2012’de ikinci baskısını yaptı ve yetersiz de olsa bazı atıf eksikliklerini tamamlamaya çalıştı. Ne var ki, Ramazan Çağlayan kitabının ikinci baskısını yaptıktan 11 ay sonra, Ocak 2013’te kitabının üçüncü baskısını yayınladı ve kitabının ikinci baskısında bana yaptığı 550 küsur atıfı, üçüncü baskıdan bir çırpıda çıkardı ve kitabın bibliyografyasından adımı da sildi. Bu eleştiri kitabını yazmak, benim Kasım 2011’den Mayıs 2013’e kadar, tam bir buçuk yılımı aldı. Ramazan Çağlayan’ın bu kitabı yüzünden sadece benim İdare Hukuku isimli kitabım usûlsüz alıntılara kurban gitmedi; bir buçuk yılım da heba oldu. Belki bu eleştiri kitabını yazmak yerine usûlsüz alıntıları görmezden gelmem, kendi işime bakmam, yarıda kalmış kitaplarımı tamamlamam en iyisi olacaktı. Bir buçuk yılım kaybolmayacak, sinirlerim gerilmeyecek ve dahası yeni kitaplarım olacaktı. Ama ben bunu yapamadım. Göz göre göre susmayı içime sindiremedim. Belki bu kitap, bana ve Ramazan Çağlayan’a vereceği zararın yanında, bir hayra da vesile olur. Türk hukuk literatüründe herkesçe bilinen, ama açıkça dile getirilmeyen usûlsüz alıntı sorununun tartışılmasına neden olur. Böylece bu kitap, bir kişisel hesaplaşma kitabı olmaktan çıkıp, belki hukukta bilimsel araştırma ve yayın etiği konusunda bir örnek olay incelemesi kitabı hâline gelir. NOT: Ramazan Çağlayan, bu kitabın internetten kaldırılmasını önce Kırıkkale 3. Sulh Ceza Mahkemesinden talep etmiş, ancak talebi bu Mahkemenin 28.6.2013 tarih ve 2013/318 sayılı kararıyla reddedilmiştir. Daha sonra Ramazan Çağlayan aynı konuda Ankara 17. Sulh Ceza Mahkemesinden talepte bulunmuş, talebi, bu Mahkeme tarafından 24/01/2014 tarih ve 2014/52 D. It is an obligation because I would like to contribute something (of all the things that I owe) in return as an appreciation of having been fortunate enough to educate myself in the Orchestras, where I learned to play Tango. The Orchestras were a crucible where the ideas of its members and/or other creative musicians experimented, played, and came together to create playing styles, rhythmic forms, etc. These contributions were what took the Tango, little by little, to such a high musical level. Nowadays, it is not at all easy to belong to an Orchestra, considering the fact that so few can subsist. This makes it more difficult for those who want to have careers in Tango music to acquire the vast knowledge necessary for playing and interpreting it. Let us not forget that the Orchestras have always been the best schools for such an apprenticeship. It is also a great pleasure to be able to transmit and share that what I have learned, trying always not to leave anything out (that is my real intention) by relying on my memory which fortunately still helps me. I never intended for my conclusions to be taken as the absolute truth, nor wanted to win something over anyone, in anything. This course just shows my position, and the ideas with which I have always worked. We will deal here with the Tango in versions which, in my understanding, are genuine manifestations of itself. I love the Tango because I love good music, and I got into it to learn to play it, not to change it. If my versions and arrangements have something different about them, it is only because this is my language, and I have expressed myself through it. I will also talk about the incorporation of new contributions and changes, as long as they are authentic within the genre. The many streams of opinion may or may not coincide with what will be said in this course. Considering the broadness of the theme and the flexibility which should govern artistic creation, other concepts may prove constructive as well. La segunda parte, La Lucha por la Monarquía Universalis, analiza y describe la evolución de estas premisas, el desarrollo de las cortes europeas y la complejidad que va adquiriendo el gobierno de los estados, la división religiosa y la compartimentación de Europa en confesiones, el alcance y efecto de la expansión europea en el mundo en la manera en que América, África y Asia se transforman con el contacto de los europeos. La tercera parte estudia el comienzo del cambio de paradigma a finales el siglo XVII, La ruptura del concepto Monarquía Universalis y la búsqueda de un equilibrio político, el sistema post westfaliano que afecta en su ideal de equilibrio tanto al orden interno de las monarquías y su reconfiguración como a la creación de los cimientos del moderno sistema internacional de estados. Los seis últimos capítulos constituyen un bloque marcado por la crisis del Antiguo Régimen, un término empleado para significar un nuevo modelo de sociedad, la sustitución del sistema cortesano por el paradigma del Estado nacional.
