Overall, 7 cultivated and 228 wild species (Hawkes, 1990) or 4 cultivated and 107 wild species (Spooner et al., 2014) were described and are conserved through 82,000 accessions in 89 institutions. This makes the Caspian region to one of the most important geo-political areas in the post-Cold War era. The question of the routes for exporting oil and gas from this land-locked area is central to the export of the Caspian energy resources. It evolves around various conflicts between the different forces involved in the Central Asian and the Caucasian regions. For example: ethnic conflicts such as the war in Nagorno-Karabakh, in Chechnya, the PKK issue in Turkey or the Taliban rule in Afghanistan. At the same time, however other problems such as lack of infrastructure and technology and finding a solution for the Caspian's legal regime could be obstacles for the possible construction of pipelines. Further, the United States does not want Iran to become a dominant power in the region and therefore would reject any route passing through this country. Turkey would like any outlets to run through its own country. The pipeline through Russia up until now is the only existing pipeline structure for the transportation of energy resources from the Caspian region. Therefore Russia has a strong interest in and influence over any alternative route being discussed. At the same time the United States want to prevent Russia from regaining domination over the former southern republics of Central Asia and Caucasus once ruled by the Soviet Union. By analysing these and other important aspects, this book helps us understand how they contribute to the problematic of conflict and co-operation around the energy resources in the Caspian region. Access to and sharing in the benefits of human biological resources are aspects not regulated by any international legal framework such as the Convention on Biological Diversity, which applies only to the exchange of plants, animals and microorganisms, as well as to associated traditional knowledge. Examples of genetic research perceived as exploitative are provided in order to illustrate the legal vacuum concerning the global governance of human genetic resources. The main conclusions drawn from the legal and ethical analysis are: • Benefit sharing is crucial in order to avoid the exploitation of developing countries in human genetic research. • With functioning research ethics committees, undue inducement is less of a concern in genetic research than in other areas of medical research (e.g. clinical trials). • Concerns remain over research involving indigenous populations; accordingly, recommendations are provided. In drawing these conclusions, the book addresses in detail a highly pressing topic in global bioethics and international law. In this regard, it combines bioethical arguments with jurisprudence, in particular with reference to the law of equity and the legal concepts of duress (coercion), unconscionable dealing, and undue inducement. |
