Attard, 2020-08-25 In The Shipmaster's Duty to Render Assistance at Sea under Internationl Law, Felicity G. Attard examines the web of applicable international rules regulating one of the most fundamental obligations at sea. The study explores the shipmaster's duty to render assistance at sea under treaty law, customary international law, and other international instruments. It focuses on an assessment of the duty in light of contemporary challenges posed by the phenomenon of irregular migration by sea, a problem which has intensified in recent years. Whilst Article 98 of the 1982 United Nations Convention on the Law of the Sea provides the basis for the regime regulating the duty, the study addresses other relevant rules adopted by the International Maritime Organization and the International Labour Organization. Due to the humanitarian ramifications of the rendering of assistance at sea, the book considers further obligations imposed under human rights law and refugee law. The study presents a comprehensive analysis of shipmaster's responsibilities in rescue operations, and their role in the fulfilment of States' international obligations in the rendering of assistance. |

iamsar 2019: Area-Based Management of Shipping Aldo Chircop, Floris Goerlandt, Ronald Pelot, Claudio Aporta, 2024-06-17 This open access book fills a gap in the literature on shipping in a number of cross-cutting fields (including marine transportation law and policy, law of the sea, Indigenous rights, marine environmental management, and risk and safety studies). Moreover, the book includes a focus on the consideration of Indigenous rights in shipping, a topic of emerging importance. There are, to our knowledge, no directly competing titles with the same interdisciplinary approach to conceptualize, understand, and describe best practices for area-based management approaches. There are, however, related titles which cover some aspects of area-based management, usually from narrow disciplinary perspectives. Area-based management in the governance of shipping has become a useful and effective approach to promote maritime safety, maritime security, and pollution prevention and to mitigate the adverse impacts of shipping on the marine environment and coastal communities. Based on the results of a research project and a major workshop convened at Dalhousie University in Canada, this book consists of multidisciplinary studies and analyses of major issues pertaining to area-based management in shipping from a comparative perspective, but with the principal focus on Canada. iamsar 2019: Freedom of Overflight Merinda E. Stewart, 2021-10-25 Freedom of overflight is in large part uncontroversial. However, several recent international disputes and subsequent scrutiny of the exercise of coastal State jurisdiction in international airspace have highlighted the problematic legal nature of this freedom – namely, how a State’s ‘creeping jurisdiction’ may encroach upon the rights of other States. This groundbreaking book examines in depth the ambiguous areas at the nexus of air law and the law of the sea with respect to the balance between coastal State jurisdiction and freedom of overflight, thus providing greater legal certainty regarding State actions involving overflight in international airspace. The author identifies and thoroughly examines three highly salient matters impacting overflight in international waters: the right of a State to establish safety zones around maritime constructions and the legitimacy of extending these safety zones to the airspace; what, if anything, under international civil aviation law specifically, prohibits a State from discriminating against the aircraft of another State in international airspace within its flight information region; and whether air defence identification zones can be justified as customary international law. Also considered is the law of the sea concerning transit passage through international straits and archipelagic sea lanes as applied to airspace users. This is the first detailed study of overflight to combine the perspectives of international civil aviation law and the law of the sea. As such, it presents a comprehensive analysis of the legality of attempts by coastal States to exercise jurisdiction in international airspace over aircraft registered in other States, thus taking a giant step towards determining what freedom of overflight entails by establishing its legitimate limitations. iamsar 2019: Modeling, Analysis, Control and Removal of Oil and Hydrocarbon Spills Tatiana Chaplina, 2025-02-21 A large number of scientific works are devoted to the study and modeling of accidental oil spills. However, there is no single approach to the description of processes and a generally accepted system of models. An additional fundamental difficulty is the impossibility of conducting full-fledged full-scale experimental studies, which makes it difficult to verify the adequacy and accuracy of oil spill models. Our book is devoted to the problems of experimental investigation and theoretical description of spills, as well as the practical removal of various petroleum products from the water surface and ice. It provides an overview of the most well-known theoretical models of the process of spreading oil stains on the water surface. Also, in the relevant sections, an original spreading model based on an energy approach is proposed and analyzed. The results of new experimental studies of the dynamics of the process for various hydrocarbons on water, including variations in its temperatureand salinity, are presented. In the following chapters, a theoretical description of oil spreading on the upper and lower surfaces of floating ice is proposed, modeling phenomena in the Arctic and subarctic zones of the world ocean. New experimental data on the spreading of petroleum products on the ice surface are presented. The final part provides a brief overview of the existing most used and promising methods for removing of hydrocarbons from the water surface. New original constructive solutions to this problem are proposed, the technical characteristics of which have received theoretical justification and experimental confirmation. |

It unravels how the interplay of the law of the sea and rules on jurisdiction widen the opportunity for states to make and enforce rules outside their territory, and questions whether this is also accompanied with an obligation to respect the right to life under the European Convention on Human Rights (ECHR) when doing so.
