hotels near ncdrc delhi: Foundations of Indian Contract Law , 2024-08-29 This new volume analyses the central doctrines and concepts of Indian contract law and provides guidance on the interpretation of the Indian Contract Act 1872 by examining its historical, philosophical, and comparative foundations. Featuring contributions from practitioners and academics from around the world, the book follows a methodology carefully calibrated to address the shortcomings in traditional Indian contract law scholarship. The primary presuppositions of this methodology are that: (a) the answers to many difficult questions of Indian contract law can be found in the history of the Contract Act; and (b) while it is difficult to understand the Contract Act other than against the backdrop of the common law, one should not assume that Indian contract law mirrors the common law on all difficult points. Each chapter therefore pays close attention to the legislative history of the relevant provision(s) of the Contract Act. Based on a holistic analysis of the Contract Act's drafting history and its current interpretation, Foundations of Indian Contract Law is a carefully crafted volume providing the input needed to influence the Indian courts' approach to contract law, inform meaningful legislative reform, and, more broadly, catalyse a culture of critical scholarship on Indian private law. Formed of 24 chapters and a conclusion by Professor Hugh Beale (former Commercial Law and Common Law Commissioner at the Law Commission of England and Wales), the volume presents an authoritative exposition of a branch of the law that is of considerable interest and great practical importance for practitioners, scholars, and students interested in Indian contract law.

hotels near ncdrc delhi: Arbitration in India Dushyant Dave, Martin Hunter, Fali Nariman, Marike Paulsson, 2021-02-24 India has a long-standing tradition of dispute resolution through arbitration, with arbitral-type regulations going back to the eighteenth century. Today, amendments to the 1996 Indian Arbitration Act, a steady evolution of case law and new arbitral institutions position India’s vibrant system once more at the forefront of international commercial dispute resolution. In this handbook, over forty members of the international arbitration community in India and beyond offer authoritative perspectives and insights into topics on arbitration that matter in India. International arbitration practitioners, Indian practitioners, and scholars have combined efforts to produce a practical and informative guide on the subject. Among numerous notable features, the contributors provide detailed analysis and description of such aspects of arbitration as the following, with a focus on the Indian context: Indian application of the 1958 New York Convention; law governing the merits of the dispute and awards; investor-state dispute settlement; drafting arbitration clauses for India-centric agreements; managing costs and time; rise of virtual arbitration and technology; effect of public policy in light of extensive Indian jurisprudence; and arbitration of claims relating to environmental damage. Practical features include checklists for drafting arbitration clauses and a comparative chart of major commercial arbitration rules applicable to India. Also included is a comparative analysis of arbitral regimes in India, Singapore and England; chapters on the India Model Bilateral Investment Treaty and ISDS reforms; a special section on the enforcement of foreign awards; a section on the drafting of the award guided by leading arbitrators and stakeholders and a review of the new 2021 ICC Rules. For foreign counsel and arbitrators with arbitrations in India, this complete and up-to-date analysis provides guidelines for practitioners, corporate counsel, and judges on considerations to be borne in mind with respect to arbitration with an Indian nexus and whilst seeking enforcement and execution of an arbitral award in India. It will prove an effective tool for students and others in understanding and navigating the particularities and peculiarities of India’s system of domestic and international commercial arbitration.
hotels near ncdrc delhi: Empowering Consumers Task Force on the Future of the Canadian Financial Services Sector, 1998 This paper addresses marketplace factors which are critical for assisting or supporting consumers of financial services in Canada. These factors are: the transparency of transactions and disclosure; privacy of personal information; redress mechanisms; non-coercive sales practices; proficiency standards; and open markets. Particular attention is paid to financial institutions (banks, trust corporations, insurance companies, credit unions) and to financial intermediaries (primarily insurance brokers and agents). The introduction includes discussion of the rationale for focusing on retail consumers and the challenge for public policy in dealing with consumer protection issues. Chapter 2 provides further context by reviewing recent broad market developments. The subsequent chapters examine each of the above factors in turn, and include comparisons with practices in other countries.

hotels near ncdrc delhi: Decentralized Capacity Building Development Academy of the Philippines, 2005-01-01 A new definition of capacity-building is evolving--one tha t is veering away from conventional ideas of organizational engineering . As it encompasses the broad environment or system in which social changes occur, capacitybuilding has become more complex, yet also more rewarding . Today, some of the buzzwords are empowerment, social capital, enabling environment. Moreover, culture, values and power rela tions that influence and motivate organizations and individuals are gaining more attention. There is respect and even appreciation now for informal patterns of personal and culture-bound organizational behavior- the unwritten rules of the game, so to speak. As well, there is the urge to complement, not replace, indigenous ha bits and practices. All of these are progressively coalescing into a body of concepts called capacity development.

hotels near ncdrc delhi: Arbitrability Loukas A. Mistelis, 2009-01-01 It often seems today that no dispute is barred from resolution by arbitration. Even the fundamental question of whether a dispute falls under the exclusive jurisdiction of a judicial body may itself be arbitrable. Arbitrability is thus an elusive concept; yet a systematic study of it, as this book shows, yields innumerable guidelines and insights that are of substantial value to arbitral practice. Although the book takes the form of a collection of essays, it is designed as a comprehensive commentary on practical issues that emerge from the idea of arbitrability. Fifteen leading academics and practitioners from Europe and the United States each explore different facets of arbitrability always with a perspective open to international developments and comparative evaluation of standards. The presentation falls into two parts: in the first the focus is on the general features of arbitrability, its rationale and the laws applicable to it. In the second, arbitrability is specifically examined in the context of administrative, criminal, corporate, IP, financial, commercial, and criminal law This book has its origins in an International Conference on Arbitrability held at Athens in September 2005. Seven papers presented there are here reviewed and updated, and nine others are added. The subject of the book and– arbitrability and– is one that is much talked about, but seldom if ever given the in-depth treatment presented here. Arbitrators and other practitioners in the field will welcome the way the analysis moves logically from theory to practice regarding every issue, and academics will recognize a definitive treatment of arbitrability as understood and applied in the settlement of disputes today.
hotels near ncdrc delhi: Misgoverned Kashmir Rameshwar JAMWAL, 2021-06-24 Union Territory of Jammu and Kashmir in India has caused so much damage to our human and other resources that it is almost impossible to measure it in physical terms. Ever since India became independent and its ruler, the only competent person to sign the instrument of accession, decided to merge it with India, like other princely states, it has been ruled by a few dozen families from Kashmir valley but as per the version of the highest-ranking civil servant of the UT of J&K, J&K was one of the worst governed parts of India. He said that Jammu and Kashmir was a broken state and there was no system in place due to years of misgovernance, corruption, and unbelievable levels of fraud committed by leaders of mainstream parties and separatist organizations. He further said that said frauds in Jammu and Kashmir were at unbelievable levels. There were frauds in jobs, frauds in projects, frauds were everywhere. The ruling class knows the perils of misgovernance as it paralyzed every organ of the system and the persons of your choice, for whom you believe are being benefitted, in fact, are the ultimate sufferers. But why these rulers have indulged in such misgovernance, was there something amiss in their genetic makeups, or their upbringing or their mental abilities, we need to find the reasons, and only then the solutions would come out. I started looking for reasons for behavioral patterns of such people and their reasons in this part of the country. Killings of thousands of persons, ruined families, devastated minds, perplexed solutions, economic losses worth billions, and uncertain future, all staring those who have some inkling about the futuristic events in store for the coming generations, and the response by the powers that be, seems to be inadequate. Neither those who are sitting in power corridors in New Delhi nor in Srinagar, have the vision to realize that there can be some biological or psychological, factors, as defined in our Philosophical literature, for such shortcomings of the ruling class. It is in this context, I have written dozens of Articles in a period of about three decades but those fade away from the memory of readers, so they needed to be presented in a format which can be available forever and then the earlier two books, written by me, have all linkages with the present work. So, I started working on this problem, scanned the history of the regions, its physical linkages with those who have ruled here, and the possible psychological reasons of misgovernance, and found some interesting aspects, which may be of some use to the powers that be, if they want a permanent solution of J&K. There is an external factor as well, which has not been touched, as it is for the Defence, Foreign and Home Ministries of Government of India to handle but the present book is confined to the misgovernance part and the possible solution, in which the role of the people of Jammu and Kashmir is also crucial. It is with this idea, the present work has been compiled, and since there were pieces of work, which pertained to some previous periods, this might create confusion but I hope that the readers will not find it confounding and since those suggestions are still applicable, the present book will be appreciated in this context.

hotels near ncdrc delhi: International Medical Malpractice Law Dieter Giesen, 1988-01-01 This monograph is the most comprehensive comparative law study of legal responsibility arising from medical care presently available. It is written for doctors as well as health care administrators and legal professionals. Focusing on the problems of civil liability, it presents the development, points of contact with, and differences between the modern law of medical liability stemming from both the Common Law and Civil Law traditions of England, Scotland, Eire, New Zealand, Australia, Canada, the United States, South Africa, France, Belgium, West Germany, Switzerland, and Austria. It demonstrates the extent to which both problems of medical law and trends towards their solution are already familiar in these legal systems. The work describes principles and trends, not by confronting the reader with national reports' and separate chapters on different legal systems; rather, the relevant legal problems are analyzed from an integrative, comparative viewpoint. The main thrust of the presentation is the analysis of numerous court decisions -- the number of which is rising ominously in the United States -- on the civil liability of doctors and hospitals for damages arising from substandard treatment or inadequate disclosure of information to the patient. References to the legal and medical literature, indexes, and a refined system of cross-references, together with an important collection of appendices covering legal and ethical declarations make this work accessible as a handbook and reference work for the legal and social problems encountered today in the wide area of law, ethics, and medicine.

Next follows the consideration of free association in its relation to scientific rhetorical, expressive and literary discourse. Mahony then begins a detailed study of certain aspects of the text of Freud's Interpretation of Dreams and of issues involved in the oral reporting of dreams. Attention is subsequently turned to the analysis of Freud's own writing in general, and specifically to Totem and Taboo. Finally, the author shows how his ideas can illuminate literary classics (by Villon, Shakespeare, Kafka, and Jonson) and the debate about whether there is anything specific to women's discourse.
hotels near ncdrc delhi: Medieval Archaeology Chris Gerrard, 2003-10-04 The archaeology of the later Middle Ages is a comparatively new field of study in Britain. At a time when archaeoloy generally is experiencing a surge of popularity, our understanding of medieval settlement, artefacts, environment, buildings and landscapes has been revolutionised. Medieval archaeology is now taught widely throughout Europe and has secured a place in higer education's teaching across many disciplines. In this book Gerrard examines the long and rich intellectual heritage of later medieval archaeology in England, Scotland and Wales and summarises its current position. Written in three parts, the author first discusses the origins of antiquarian, Victorian and later studies and explores the pervasive influence of the Romantic Movement and the Gothic Revival. The ideas and achievements of the 1930s are singled out as a springboard for later methodological and conceptual developments. Part II examines the emergence of medieval archaeology as a more coherent academic subject in the post-war years, appraising major projects and explaining the impact of processual archaeology and the rescue movement in the period up to the mid-1980s. Finally the book shows the extent to which the philosophies of preservation and post-processual theoretical advances have begun to make themselves felt. Recent developments in key areas such as finds, settlements and buildings are all considered as well as practice, funding and institutional roles. Medieval Archaeology is a crucial work for students of medieval archaeology to read and will be of interest to archaeologists, historians and all who study or visit the monuments of the Middle Ages.

hotels near ncdrc delhi: The Durable Slum Liza Weinstein, 2014 In the center of Mumbai, next to the city's newest and most expensive commercial developments, lies one of Asia's largest slums, where as many as one million squatters live in makeshift housing on one square mile of government land. This is the notorious Dharavi district, best known from the movie Slumdog Millionaire. In recent years, cities from Delhi to Rio de Janeiro have demolished similar slums, at times violently evicting their residents, to make way for development. But Dharavi and its residents have endured for a century, holding on to what is now some of Mumbai's most valuable land. In The Durable Slum, Liza Weinstein draws on a decade of work, including more than a year of firsthand research in Dharavi, to explain how, despite innumerable threats, the slum has persisted for so long, achieving a precarious stability. She describes how economic globalization and rapid urban development are pressuring Indian authorities to eradicate and redevelop Dharavi--and how political conflict, bureaucratic fragmentation, and community resistance have kept the bulldozers at bay. Today the latest ambitious plan for Dharavi's transformation has been stalled, yet the threat of eviction remains, and most residents and observers are simply waiting for the project to be revived or replaced by an even grander scheme. Dharavi's remarkable story presents important lessons for a world in which most population growth happens in urban slums even as brutal removals increase. From Nairobi's Kibera to Manila's Tondo, megaslums may be more durable than they appear, their residents retaining a fragile but hard-won right to stay put.

hotels near ncdrc delhi: The Sixth Force in Cosmos Rameshwar Singh Jamwal, 2020-07-06 Scientific community, especially the physicists and cosmologists have tried to penetrate the lifeless creations of nature to find answers not only for origin of this creation called cosmos, but also for its most intriguing aspect, the generation of life and many more have also tried to find the life and death cycles of different creatures. The entire regulation or management of life cycles of trillions and trillions of creatures is such a mind boggling and massive task that the life less creations of nature would be unable to handle it but scientists and philosophers are still on the job and will continue to do so because we still have to travel millions of light years to reach and probe those corners of this universe, where even our massive telescopes and sophisticated cameras have not been able to take a shot. In the process we have made sufficient progress but still we have not been able to travel beyond the boundaries of this small planetary system, so to find answers for so many intriguing things, just by looking at these distant corners from giant telescopes may not be sufficient. We depended too much on inanimate objects to reveal the secrets of animates, without a probe of which; our journey would not be complete. But the life less creations of nature; galaxies, stars, planets, mountains, rivers, atoms and their sub atomic parts are not the only reasons of our predicament, there were other phenomenon, which have defied the scientific explanations. We are still groping in the dark whether the humans are a different species or fall in the same category of other creatures. If we recognize and appreciate the lifelong efforts of the scientists to find out the truth, which have helped us to reach this stage of modernization, we can't ignore the contributions of Prophets and sages of all religions, who also spent their entire lives in search of the same ultimate truth, may be, by adopting a different path. Our efforts to develop and experiment with Hadron Collider at CERN and other places, our journeys into space, the efforts to locate and find the source of black holes and other stars will certainly help us to some extent but we have to realize that we will have to find a harmonious blend of all these concepts and theories of science with logical and well reasoned thoughts and mystic traditions of India. We may, ultimately have to realize and acknowledge that the concept of Apara and Para energies, which as per Bhagvad Gita, permeate all living and non living things of all the Universes, and which have been termed as Brahman are the Fifth and Sixth Forms of energy and are worth giving a serious thought by the scientific community. The supreme is possessed of these two energies, which represent the unconscious and conscious aspect of the universe. The lower nature, called 'Apara' produces effects and modifications in the world of nature or of causes; the higher nature, called 'Para' gives rise to 'purusa' or the intelligent souls. Both of them form the nature of one supreme and are the constitutive stuff of the world. The assumptions about the nature, black holes, the relativity theories, the string theory, the initial configuration of universe after the big bang and much more and all our scientific efforts may help us to some extent but still we will need to combine the other fields of science, from biology to neuro biology, from genetics to epigenetics, and from the concepts of evolution of species, the generation of life, the difference between humans and other forms of life. The philosophies, which answer all these intricate questions, and questions of wide import, can be found in Indian philosophies in an elaborate manner. Our objective is to find out those forces, which make our brains to activate genes, switch them on and off, produce different types of proteins and in different quantities and form neuro transmitters, send signals through them and many other complicated processes, which we do.
