In this current age of world without borders due to globalization, it becomes necessary for experts in the social and Islamic science fields to collaborate together to come up with a solution that simultaneously fulfills both the local and international market demands. Aris, Perbincangan buku ini tertumpu kepada makhluk babi yang menimbulkan polemik dalam pelbagai isu sama ada makanan, kesihatan dan sebagainya. Babi merupakan organisma hidup yang disebut lima kali di dalam al-Quran, tujuh kali di dalam hadis, seterusnya dihukum haram dan najis oleh kebanyakan fuqaha. Terdapat dalam kalangan ulama mentafsirkan ayat berkaitan babi dengan mengaitkannya dengan kesihatan serta menghubungkan dengan elemen maqasid syarciyyah di samping menjelaskan babi mendatangkan kemudaratan melalui penyakit yang dibawanya. Di sebalik pengharaman babi, penyelidikan dalam buku ini turut merungkai kepelbagaian manfaat kesihatan khususnya melibatkan proses xenotransplantasi yang bertindak sebagai medium terapeutik pada masa kini. Hasil penyelidikan mendapati bahawa, babi mempunyai sistem anatomi, fisiologi, metabolik seakan-akan manusia yang menjadikannya mudah diterima oleh badan manusia. Namun begitu, perlu diketahui bahawa babi juga merupakan binatang yang memudaratkan dari sudut penyakit. Penulisan ini menganalisis manfaat xenotransplantasi ke atas unsur babi terpilih yang berfungsi untuk dijadikan alternatif antaranya injap jantung, hati, buah pinggang, sel β islet, insulin dan sel neural babi. Penggunaan unsur-unsur tersebut tertakluk kepada konsep darurah yang turut melibatkan kaedah qiyas dan maslahah bagi menyelesaikan isu berkaitan dengan pertembungan antara manfaat dengan mudarat babi. Kajian ini juga mendapati bahawa, proses xenotransplantasi unsur babi turut memindahkan retrovirus berbahaya iaitu porcine endogenous retrovirus (PERV) ke dalam badan manusia yang berupaya melakukan integrasi bersama-sama genom sel dan tisu hidup manusia. Oleh sebab itu keharusan dan pengharaman penggunaan unsur babi bagi tujuan kesihatan perlu berasaskan konsep tacbudiyyah (perhambaan) dan bukannya atas konsep tacakuliyyah (rasional) semata-mata. Penggunaan babi menjadi isu kritikal apabila menyentuh soal kesihatan yang merupakan salah satu perkara penting bagi memelihara elemen maqasid syari’ah iaitu pemeliharaan kepada jiwa (Hifz al-Nafs).

Western economic systems use interest to distribute financial resources efficiently for investment and/or consumption, while Islamic economies pursue a completely different strategy for financing loans, which adheres to Islamic laws and prohibits the activities of conventional banking systems with regard to interest. This book argues that there is scope for new definitions and analysis based on alternative concepts which respect Islamic values and principles, yet pave the way for modification and debate. The book comprises of two parts. Theoretical issues are dealt with in the first section. The first two chapters examine conventional Islamic views on the prohibition of riba, while Chapters 3 and 4 contain unprecedented and alternative theoretical analysis based on concepts such as earned (halal-permitted-legal) vs. unearned (haram-impermissible-illegal) income and SUKUK, that is, Islamic interest-free bonds. The second part of the book tackles another unconventional aspect of Islamic finance, that is, the concept of NAS. The book considers whether the NAS-influenced anti-inflationary interest policy was a success or failure. Empirical data is evaluated in terms of bank incomes, inflation rate, interest rate, and the distribution of income. Islamic Jurisprudence (Fiqh) has yet to develop its conceptualization of this modality of financing. Thus far, it has become a norm for large financing projects to rely on a complex structure of interconnected bilateral contracts that in totality becomes opaque, complex and costly. An unfortunate result of the unavailability of an efficient Fiqhi model applicable to modern multilateral and multi-counterparty contracts has been the fact that the present Islamic finance has been forced to replicate conventional risk-transfer (interest rate based) debt contracts thus drawing severe criticisms of duplicating conventional finance. In 2012, a gathering of some of the Muslim world’s most prominent experts in Jurisprudence (Fuqaha) and economists issued the Kuala Lumpur Declaration (Fatwa) in which they identified risk sharing as the essence of Islamic finance. The Declaration opened the door for a new Fiqh approach to take the lead in developing the jurisprudence of multilateral and multi-counterparty transactions. This Declaration (Fatwa) provides a prime motivation to search for a comprehensive model of risk sharing that can serve as an archetypal contract encompassing all potential contemporary financial transactions. From the perspective of Islamic Jurisprudence (Fiqh), the technicalities of the concept of risk sharing in contemporary finance have yet to be defined in Islamic literature. This book attempts to clarify and shed light on these technicalities from the perspective of Fiqh. It is a comprehensive study that relies on the fundamental Islamic sources to establish a theoretical and practical perspective of Fiqh encompassing risk-sharing Islamic finance as envisioned in the Kuala Lumpur Declaration of 2012. This new paradigm should lead to a more efficient approach to multilateral and multi-counterparty Islamic contracts which, here-to-fore has been lacking in the current configuration of Islamic finance.
