Lyme disease is the most common disease carried by ticks in the United States, and the number of those afflicted is growing steadily. If left untreated, the diseases carried by ticks-known as tick-borne diseases-can cause severe pain, fatigue, neurological problems, and other serious health problems. The Institute of Medicine held a workshop October 11-12, 2010, to examine the state of the science in Lyme disease and other tick-borne diseases. |

derek acree attorney: Regulation through Litigation Kip W. Viscusi, 2004-05-13 Recent high-profile lawsuits involving cigarettes, guns, breast implants, and other products have created new frictions between litigation and regulation. Increasingly, litigation is being used as a financial lever to force companies to accept negotiated regulatory policies—policies that invariably involve less public input and accountability than those arising from government regulation. The process not only usurps the traditional governmental authority for regulation, but also shifts the locus of establishing tax policy from the legislature to the parties involved in the litigation. Citizen interests are not explicitly represented and there is no mechanism to ensure that these outcomes are in society's best interests. By focusing on case studies involving the tobacco industry, guns, lead paint, breast implants, and health maintenance organizations, the contributors to this volume collectively shed light on the likely consequences of regulation through litigation for insurance markets and society at large. They analyze the ramifications of large-scale lawsuits, mass torts, and class actions for the insurance market, and advocate increased public scrutiny of attorney reimbursement and a competitive bidding process for all lawsuits involving government entities as the plaintiffs. |
derek acree attorney: To Drink from the Well Geeta Kapur, 2021-05-04 Law professor and civil rights activist Geeta Kapur chronicles systemic racism in leadership, scholarship, and organizational foundations at University of Chapel Hill. The University of North Carolina is the oldest public university in the US, with the cornerstone for the first dormitory, Old East, laid in 1793. At that ceremony, the enslaved people who would literally build that structure were not acknowledged; they were not even present. In fact, 158 years passed before Black students were admitted to this university in Chapel Hill, and it was another 66 years after that before students forcibly removed the long-criticized Confederate Silent Sam monument. Indeed, this university, revered in the state and the nation, has been entwined with white supremacy and institutional racism throughout its history--and the struggle continues today. To Drink from the Well: The Struggle for Racial Equality at the Nation's Oldest Public University explores the history of UNC by exposing the plain and uncomfortable truth behind the storied brick walkways, historic statuary, and picturesque covered well, the icon of the campus. Law professor and civil rights activist Geeta Kapur chronicles the racism in the leadership, scholarship, and organizational foundations of the school and traces its insidious effects on students, faculty, and even the venerable Tarheel sports programs. Kapur explores the Chapel Hill campus and a parallel movement in nearby Durham, where a growing Black middle class helped to create North Carolina Central University, a historically Black public university. |

derek acree attorney: Redeeming the Dream Theodore B. Olson, David Boies, 2014-06-17 “Breathtakingly inspiring.” —Laurence H. Tribe, Professor of Constitutional Law, Harvard Law School When advocates for marriage equality sought to challenge California’s notorious Proposition 8, they were fortunate to have the support of two of the nation’s preeminent lawyers, David Boies and Theodore B. Olson. Despite the fact that they had argued against one another in the landmark Bush v. Gore case, their commitment to the marriage issue led them to join forces, ultimately defeating the unconstitutional proposition in the Supreme Court after a nearly five-year battle. Redeeming the Dream is the definitive inside account of the key civil rights struggle of our time. |

derek acree attorney: The Constitution of Law David Dyzenhaus, 2006-10-05 Dyzenhaus deals with the urgent question of how governments should respond to emergencies and terrorism by exploring the idea that there is an unwritten constitution of law, exemplified in the common law constitution of Commonwealth countries. He looks mainly to cases decided in the United Kingdom, Australia and Canada to demonstrate that even in the absence of an entrenched bill of rights, the law provides a moral resource that can inform a rule-of-law project capable of responding to situations which place legal and political order under great stress. Those cases are discussed against a backdrop of recent writing and judicial decisions in the United States of America in order to show that the issues are not confined to the Commonwealth. The author argues that the rule-of-law project is one in which judges play an important role, but which also requires the participation of the legislature and the executive. |

derek acree attorney: Property and The Human Rights Act 1998 Tom Allen, 2005-10-01 By giving further effect to the European Convention on Human Rights, the Human Rights Act 1998 has had a significant effect on property law. Article 1 of the First Protocol to the Convention is particularly important, as it protects against the interference with the enjoyment of possessions. Compulsory acquisition, insolvency, planning, taxation, environmental regulation, and landlord and tenant laws are just some of the fields where the British and European courts have already had to assess the impact of the Protocol on private property. The Human Rights Act 1998 also restricts the scope of property rights, as some Convention rights conflict with rights of private property. For example, the Article 8 right to respect for the home has been used to protect against environmental harm, in some cases at the expense of property and economic rights. This book seeks to provide a structured approach to the extensive case law of the European Court of Human Rights and the UK courts on these issues, and to provide guidance on the direction the law is likely to take in future. Chapters cover the history and drafting of the relevant Convention rights, the scope and structure of the rights (especially Article 1 of the First Protocol), and how, through the Human Rights Act 1998, the Convention rights have already affected and are likely to affect developments in selected areas of English law. |
derek acree attorney: Corporations Are People Too Kent Greenfield, 2018-10-23 Why we’re better off treating corporations as people under the law—and making them behave like citizens Are corporations people? The U.S. Supreme Court launched a heated debate when it ruled in Citizens United that corporations can claim the same free speech rights as humans. Should corporations be able to claim rights of free speech, religious conscience, and due process? Kent Greenfield provides an answer: Sometimes. With an analysis sure to challenge the assumptions of both progressives and conservatives, Greenfield explores corporations' claims to constitutional rights and the foundational conflicts about their obligations in society. He argues that a blanket opposition to corporate personhood is misguided, since it is consistent with both the purpose of corporations and the Constitution itself that corporations can claim rights at least some of the time. The problem with Citizens United is not that corporations have a right to speak, but for whom they speak. The solution is not to end corporate personhood but to require corporations to act more like citizens. |

derek acree attorney: The State of U.S. History Melvyn Stokes, 2002-03 Historians are very much aware of the variety of national and international trends that have shaped historical inquiry in recent decades. Americanists, in particular, have been conscious of the growing importance of gender issues, the 'turn' to questions of language and meaning, the increasing significance of cultural matters, and a new emphasis on regional history. The 1990s, moreover, saw a major movement to internationalize approaches to American history by emphasizing comparisons with other countries and cultures. By the end of the twentieth century it was by no means clear whether there was any distinctive 'American' history or, if it did exist, what its main contours were. This book brings together a distinguished international group of scholars in an effort to answer this key question through a sustained interrogation of the periods, themes, fields, problems and perspectives in historical writing on the United States. How have the intricate issues surrounding gender, race, slavery and civil rights been resolved and interpreted in recent American history? How have historians dealt with the complexities of events such as the American Revolution, the Civil War, Reconstruction and the New Deal in developing their historical narratives? In what ways have technological developments in industry, print and film influenced the questions historians ask?The State of U.S. History offers an exciting introduction to the debates surrounding the major trends in American historical debates and the crucial events and influences that have helped define the American experience. |
