central falls mesothelioma legal question: Causation in Negligence Sarah Green, 2015-01-15 The principal objective of this book is simple: to provide a timely and effective means of navigating the current maze of case law on causation, in order that the solutions to causal problems might more easily be reached and the law relating to them more easily understood. The need for this has been increasingly evident in recent judgments dealing with causal issues: in particular, it seems to be ever harder to distinguish between the different 'categories' of causation and, consequently, to identify the legal test to be applied on any given set of facts. Causation in Negligence will make such identification easier, both by clarifying the parameters of each category and mapping the current key cases accordingly, and by providing one basic means of analysis which will make the resolution of even the thorniest of causal issues a straightforward process. The causal inquiry in negligence seems to have become a highly complicated and confused area of the law. As this book demonstrates, this is unnecessary and easily remedied. |

central falls mesothelioma legal question: The Political Economy of Workplace Injury in Canada Bob Barnetson, 2010 Workplace injuries are common, avoidable, and unacceptable. The Political Economy of Workplace Injury in Canada reveals how employers and governments engage in ineffective injury prevention efforts, intervening only when necessary to maintain standard legitimacy. Barnetson sheds light on this faulty system, highlighting the way in which employers create dangerous work environments yet pour billions of dollars into compensation and treatment. Examining this dynamic clarifies the way in which production costs are passed on to workers in the form of workplace injuries. |
central falls mesothelioma legal question: The asbestos lie. The past and present of an industrial catastrophe Maria Roselli, journalist, 2014-06-24 For decades asbestos was considered an ideal substance and therefore was called 'the mineral of the twentieth century'. Even though the fiber had already proven much earlier to cause various ailments, a real boom began in the 1950s and prospered everywhere in Europe. This book retraces the history of the Swiss asbestos cement company Eternit, investigating the strategy it developed – together with other asbestos industrialists – to prevent this carcinogen from being outlawed until, in 1999, an EU Directive was finally adopted to this end. The book also reviews the struggle of the asbestos workers and their families to gain official recognition of, and compensation for, the harm suffered. |
central falls mesothelioma legal question: Defending the Indefensible Jock McCulloch, Geoffrey Tweedale, 2008-07-24 In the early twentieth century, asbestos had a reputation as a lifesaver. In 1960, however, it became known that even relatively brief exposure to asbestos can cause mesothelioma, a virulent and lethal cancer. Yet the bulk of the world's asbestos was mined after 1960. Asbestos usage in many countries continued unabated. This is the first global history of how the asbestos industry and its allies in government, insurance, and medicine defended the product throughout the twentieth century. It explains how mining and manufacture could continue despite overwhelming medical evidence as to the risks. The argument advanced in this book is that asbestos has proved so enduring because the industry was able to mount a successful defense strategy for the mineral - a strategy that still operates in some parts of the world. This defence involved the shaping of the public debate by censoring, and sometimes corrupting, scientific research, nurturing scientific uncertainty, and using allies in government, insurance, and medicine. The book also discusses the problems of asbestos in the environment, compensating victims, and the continued use of asbestos in the developing world. Its global focus shows how asbestos can be seen as a model for many occupational diseases - indeed for a whole range of hazards produced by industrial societies. The book is based on a wealth of documentary material gained from legal discovery, supplemented by evidence from the authors' visits and researches in the US, the UK, Canada, Kazakhstan, Zimbabwe, Australia, Swaziland, and South Africa. |

central falls mesothelioma legal question: Public Regulation of Tumor Banks Xavier Bioy, 2018-06-30 The multidisciplinary book assesses the legal and economic uncertainties surrounding the collection, storage, provision and economic development of biological samples (tumors, tissues, cells) and associated personal data related to oncology. Public, partly public and private sector actors in the field of cancer care and research hold collections supported by significant public and social funding. Under certain conditions, particularly in the context of networking (sometimes promoted by public authorities), these collections can also represent major economic assets and scientific resources. However, this involves a number of issues and institutional constraints: legal: the will of the source person; non-pecuniary damage; freedom to establish collections; competence in deciding on their use; legal frameworks for their distribution; desire for return on investment for public institutions, notably in terms of industrial and intellectual property. economic: cost of establishing and running biological resource centres; destroying resources; emerging markets; profit sharing. public health policy choices: prioritisation of therapeutic measures over research (fundamental or clinical trials); conservation of resources; promotion of scientific (and not commercial) value of collections. The establishment, heritage recognition (“patrimonialisation”), development and sharing of these resources thus merit our calling into question present practices and their evolution, as well as the leverage available to public authorities (incentives, legislation, regulation) in a context where norms emerge from professional practice to become widely used in collaborative networks. Filling a gap in the current literature on law and economics, which pays little heed to these specific considerations, this book explores these considerations to bring to light the economic implications of ethical choices and governance issues in the health sector (structural organisation of local, national and European actors in oncology). It is intended for researchers in fields such as law, economics and biomedical sciences, as well as for public policymakers. |
central falls mesothelioma legal question: A Smarter National Surveillance System for Occupational Safety and Health in the 21st Century National Academies of Sciences, Engineering, and Medicine, Health and Medicine Division, Board on Health Sciences Policy, Division of Behavioral and Social Sciences and Education, Committee on National Statistics, Division on Earth and Life Studies, Board on Agriculture and Natural Resources, Committee on Developing a Smarter National Surveillance System for Occupational Safety and Health in the 21st Century, 2018-04-27 The workplace is where 156 million working adults in the United States spend many waking hours, and it has a profound influence on health and well-being. Although some occupations and work-related activities are more hazardous than others and face higher rates of injuries, illness, disease, and fatalities, workers in all occupations face some form of work-related safety and health concerns. Understanding those risks to prevent injury, illness, or even fatal incidents is an important function of society. Occupational safety and health (OSH) surveillance provides the data and analyses needed to understand the relationships between work and injuries and illnesses in order to improve worker safety and health and prevent work-related injuries and illnesses. Information about the circumstances in which workers are injured or made ill on the job and how these patterns change over time is essential to develop effective prevention programs and target future research. The nation needs a robust OSH surveillance system to provide this critical information for informing policy development, guiding educational and regulatory activities, developing safer technologies, and enabling research and prevention strategies that serves and protects all workers. A Smarter National Surveillance System for Occupational Safety and Health in the 21st Century provides a comprehensive assessment of the state of OSH surveillance. This report is intended to be useful to federal and state agencies that have an interest in occupational safety and health, but may also be of interest broadly to employers, labor unions and other worker advocacy organizations, the workers' compensation insurance industry, as well as state epidemiologists, academic researchers, and the broader public health community. The recommendations address the strengths and weaknesses of the envisioned system relative to the status quo and both short- and long-term actions and strategies needed to bring about a progressive evolution of the current system. |

central falls mesothelioma legal question: Punitive Damages Cass R. Sunstein, Reid Hastie, John W. Payne, David A. Schkade, W. Kip Viscusi, 2008-12-19 Over the past two decades, the United States has seen a dramatic increase in the number and magnitude of punitive damages verdicts rendered by juries in civil trials. Probably the most extraordinary example is the July 2000 award of $144.8 billion in the Florida class action lawsuit brought against cigarette manufacturers. Or consider two recent verdicts against the auto manufacturer BMW in Alabama. In identical cases, argued in the same court before the same judge, one jury awarded $4 million in punitive damages, while the other awarded no punitive damages at all. In cases involving accidents, civil rights, and the environment, multimillion-dollar punitive awards have been a subject of intense controversy. But how do juries actually make decisions about punitive damages? To find out, the authors-experts in psychology, economics, and the law-present the results of controlled experiments with more than 600 mock juries involving the responses of more than 8,000 jury-eligible citizens. Although juries tended to agree in their moral judgments about the defendant's conduct, they rendered erratic and unpredictable dollar awards. The experiments also showed that instead of moderating juror verdicts, the process of jury deliberation produced a striking severity shift toward ever-higher awards. Jurors also tended to ignore instructions from the judges; were influenced by whatever amount the plaintiff happened to request; showed hindsight bias, believing that what happened should have been foreseen; and penalized corporations that had based their decisions on careful cost-benefit analyses. While judges made many of the same errors, they performed better in some areas, suggesting that judges (or other specialists) may be better equipped than juries to decide punitive damages. Using a wealth of new experimental data, and offering a host of provocative findings, this book documents a wide range of systematic biases in jury behavior. It will be indispensable for anyone interested not only in punitive damages, but also jury behavior, psychology, and how people think about punishment. |

central falls mesothelioma legal question: Chemical Alert! Marvin S. Legator, Sabrina F. Strawn, 2010-07-05 In the 1978 Love Canal toxic waste crisis, concerned citizens did a far better job of evaluating the health of the community than did the professionals of the New York Health Department, asserts Marvin Legator. In Chemical Alert! A Community Action Handbook, he and coeditor Sabrina Strawn offer a step-by-step guide that can be used by any lay person or citizens' group to determine whether a health risk exists in their area. Writing for the general reader with no scientific expertise, environmental, medical, and legal professionals instruct communities on the organizational and investigative techniques that will produce a valid, scientific case study. With these tools, citizens living near petrochemical plants or waste disposal areas—or who may have simply noticed a high incidence of certain health problems in their community—can determine for themselves whether a problem really exists and seek remediation. Given the reality that government agencies often lack the resources—or the will—to detect health hazards before they affect a community, an informed citizenry should be its own best environmental watchdog. |
