a gift for muslim bride: Muslim Marriage in Western Courts Dr Pascale Fournier, 2013-02-28 This book describes and analyses the notion of Mahr, the Muslim custom whereby the groom has to give a gift to the bride in consideration of the marriage. It explores how Western courts, specifically in Canada, the United States, France, and Germany, have approached and interpreted Mahr. Although the outcomes of the cases provide an illustrative framework for the book, the focus is broader than simply the adjudicative endeavours. The work explores the concept of liberalism, which purportedly champions individuals and individual choice concurrently with freedom and equality. Tensions between and among these concepts, however, inevitably arise. The acknowledgment and exploration of these intertwined tensions forms an important underpinning for the book. Through the analysis of case law from these four countries, this study suggests that transplanting Mahr from Islamic law into a Western courtroom cannot be undone: it immediately becomes rooted in the countries' legal, historical, political, and social backgrounds and flourishes (or fails) in diverse and unexpected ways. Rather than being the concept described by classical Islamic jurists, Mahr is interpreted according to wildly varied legal constructs and concepts such as multiculturalism, fairness, public policy, and gender equality. Moreover, Islamic law travels with a multiplicity of voices, and it is this complex hybridity (a fragmented and disjointed Mahr) which will be mediated through Western law. Returning to the overarching concept of liberalism, the book proposes that distributive consequences rather than recognition occupy central place in the evaluation of the legal options available to Muslim women upon divorce.

a gift for muslim bride: No Truth Without Beauty Leena El-Ali, 2021-12-01 In this comprehensive open access book, written for readers from any or no religious background, Leena El-Ali does something remarkable. Never before has anyone taken on every last claim relating to Islam and women and countered it not just with Qur’anic evidence to the contrary, but with easy-to-use tools available to all. How can a woman’s testimony be worth half of a man’s? How can men divorce their wives unilaterally by uttering three words? And what’s with the obsession with virgins in Paradise? Find the chapter on any of the seventeen topics in this book, and you will quickly learn a) where the myth came from and b) how to bust it. The methodology pursued is simple. First, the Qur’an is given priority over all other literary or “scriptural” sources. Second, the meaning of its verses in the original Arabic is highlighted, in contrast to English translations and/or widespread misunderstanding or misinterpretation.

a gift for muslim bride: China and Islam Matthew S. Erie, 2017-05-11 China and Islam examines the intersection of two critical issues of the contemporary world: Islamic revival and an assertive China, questioning the assumption that Islamic law is incompatible with state law. It finds that both Hui and the Party-State invoke, interpret, and make arguments based on Islamic law, a minjian (unofficial) law in China, to pursue their respective visions of 'the good'. Based on fieldwork in Linxia, 'China's Little Mecca', this study follows Hui clerics, youthful translators on the 'New Silk Road', female educators who reform traditional madrasas, and Party cadres as they reconcile Islamic and socialist laws in the course of the everyday. The first study of Islamic law in China and one of the first ethnographic accounts of law in postsocialist China, China and Islam unsettles unidimensional perceptions of extremist Islam and authoritarian China through Hui minjian practices of law.

a gift for muslim bride: Evangelical Christians in the Muslim Sahel Barbara M. Cooper, 2006-07-10 This “fascinating historical account” of a Christian mission in Niger offers a personal and richly detailed look at religious institutions in the region (Religious Studies Review). Barbara M. Cooper looks closely at the Sudan Interior Mission, an evangelical Christian mission that has taken a tenuous hold in a predominantly Hausa Muslim area on the southern fringe of Niger. Based on sustained fieldwork, personal interviews, and archival research, this vibrant, sensitive, compelling, and candid book gives a unique glimpse into an important dimension of religious life in Africa. Cooper’s involvement in a violent religious riot provides a useful backdrop for introducing other themes and concerns such as Bible translation, medical outreach, public preaching, tensions between English-speaking and French-speaking missionaries, and the Christian mission’s changing views of Islam.
a gift for muslim bride: Islamic Feminisms Roja Fazaeli, 2016-11-10 This book explores the contentious topic of women’s rights in Muslim-majority countries, with a specific focus on Iran and the Iranian women’s movement from 1906 to the present. The work contextualizes the authorial self through the use of personal narrative and interviews. A new critique of Islamic law is produced through an in-depth study of the Iranian Constitution, civil and criminal codes. The work presents a novel reconceptualization of the term Islamic feminism by revisiting the arguments of various scholars and through analysis of interviews with Iranian women’s rights activists. It is contended that the feminist movements can play a critical role in Islamic law reform and consequently the eventual implementation of international human rights law in Muslim-majority countries. What emerges from this study is not only a feminist critique of two major regimes of law, but also the identification of possibilities for reform in the future. The study transitions from the Iranian national context to the international by way of a comparative legal study of international human rights laws and Islamic laws. The book will appeal both to academics and human rights practitioners.
